This Privacy Policy applies to Vibrant Finishes Painting Services (Vibrant Finishes, we, us or our) and our painting, decorating, coating, maintenance, quoting, marketing and related business activities in New South Wales and elsewhere in Australia.

It covers personal information collected through our website, online quote and contact forms, Google Ads lead form assets, Facebook and Instagram lead forms, social media messages, telephone calls, SMS, email, in-person site visits, referrals, online directories, marketplaces, review platforms, competitions, promotions, subcontractor and supplier dealings, recruitment enquiries and any other channel through which you interact with us.

We seek to manage personal information consistently with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth) and other applicable Australian laws. Some small businesses may be exempt from parts of the Privacy Act; regardless, we use this policy as our standard for responsible information handling.

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not the information is true and whether or not it is recorded in a material form. property type, project address, ownership or authority to request work, access details and availability;

project details, areas to be painted, preferred colours or products, photographs, videos, plans, measurements, condition reports, budgets, timeframes and quotation requirements;

information entered into lead forms, including responses to qualifying questions and marketing consent selections;

messages, call notes, voicemail, correspondence, feedback, reviews, complaints and records of our dealings with you;

quote, contract, variation, invoice, payment and transaction information; and

information about another person that you provide, such as a property owner, tenant, strata manager, builder, architect or authorised contact.

3.2 Website, advertising and technical information

IP address, device and browser type, operating system, approximate location, referral source and pages viewed;

dates, times and duration of visits, clicks, form interactions and advertising campaign identifiers;

cookie, pixel, tag and similar technology data;

whether an advertisement, email or SMS was opened, clicked or resulted in an enquiry; and

information used to measure advertising performance, prevent fraud and improve our website and campaigns.

3.3 Business, supplier and subcontractor information

business contact details, ABN, licence, insurance, qualification and trade information;

banking and payment details, quotations, purchase orders, invoices and work records;

site induction, safety, incident, compliance and performance information; and

references and information reasonably required to assess capability, suitability and compliance.

3.4 Recruitment information

If you apply for work, employment, an apprenticeship or subcontracting opportunities, we may collect your resume, work history, references, qualifications, licences, right-to-work information and other information relevant to assessing your application. We do not ask you to provide unnecessary sensitive information.

3.5 Sensitive information

We generally do not need sensitive information. We may collect limited health, accessibility or safety information where it is reasonably necessary to safely attend a property or perform work, and where you consent or the law otherwise permits. Please avoid including sensitive information in a general lead form unless it is necessary.

4. How we collect information

We usually collect information directly from you when you submit a form, call or message us, request a quotation, book a site visit, enter into a contract, make a payment, leave a review, respond to a survey or communicate with our team.

We may also collect information from:

Google services, including Google Ads lead form assets, Google Business Profile and website analytics or advertising tools;

Meta services, including Facebook and Instagram Instant Forms, pages, advertising tools, Messenger and direct messages;

other advertising networks, online directories, lead-generation services, trade marketplaces, review websites and social platforms through which you choose to enquire;

builders, strata managers, property managers, real estate agents, designers, architects, insurers, suppliers, subcontractors and referral partners;

publicly available sources, where lawful and reasonably necessary; and

our website technologies, such as cookies, tags, pixels, analytics and server logs.

Where a platform collects your information before sending it to us, that platform's privacy policy also applies to its collection and handling. We receive the fields you submit and may also receive campaign, form and consent metadata supplied by the platform.

5. Lead forms and quotation enquiries

5.1 Forms covered

This section applies to all enquiry and lead forms, including forms hosted on our website; embedded booking or quotation tools; Google Ads lead forms; Facebook and Instagram Instant Forms; click-to-message advertisements; landing pages; third-party directory or marketplace forms; QR-code forms; referral forms; and forms completed by our staff during a call or site visit.

5.2 What happens after you submit a lead

When you submit a lead, you request or authorise contact about the project described in the form. We may contact you by telephone, SMS, email, social media message or another method you selected to:

confirm your enquiry and clarify the work required;

assess whether we service your location and project type;

arrange a site inspection, prepare or revise a quote, and follow up on that quote;

answer questions, schedule work and provide customer service; and

keep records of the lead, our response and the outcome.

Submitting a lead does not require you to accept a quotation. If a form contains a separate marketing opt-in, promotional contact will be handled according to that choice. Service-related contact needed to respond to your enquiry is not treated as an optional newsletter subscription.

5.3 Lead validation and duplicates

We may check whether contact details appear valid, combine duplicate enquiries, identify spam or fraudulent submissions, attribute a lead to an advertising campaign and record whether we have previously contacted or quoted for you. We do not knowingly sell personal lead information.

6. Why we collect, use and disclose information

We may use and disclose personal information for purposes including:

responding to enquiries and providing estimates, quotations, site inspections and painting services;

7. If you do not provide information

However, if you do not provide information needed to identify the property, understand the project, contact you or meet legal and safety requirements, we may be unable to quote, attend the site, enter into a contract or provide the requested service.

8. Direct marketing and communications

Where permitted by law, we may use contact details to send information about painting services, seasonal offers, reminders, maintenance, related services or promotions that may interest you. We may rely on your express consent, inferred consent arising from our relationship or another lawful basis.

Electronic marketing will identify the sender and include a functional unsubscribe method. You may opt out at any time by using an unsubscribe link, replying STOP to an SMS where available, telling the caller, or contacting us through vibrantfinishes.com. We will action requests within the period required by law and may retain a suppression record so we do not contact you again for marketing.

Opting out of marketing will not prevent necessary communications about an active enquiry, quotation, booking, contract, invoice, warranty issue or legal obligation. We do not use sensitive information for direct marketing unless permitted by law.

Retention periods vary. Unsuccessful or inactive leads may be retained for a reasonable follow-up and recordkeeping period; project, contract, invoice and warranty records may be kept longer where needed. When information is no longer required and no law requires retention, we take reasonable steps to delete, destroy or de-identify it. Backup copies may remain for a limited period until overwritten through normal backup cycles.

15. Access and correction

You may request access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. We may ask for reasonable proof of identity before responding. We will respond within a reasonable period and generally will not charge for making a request. Where we seek to use a testimonial, identifiable image, address or other personal information for promotional purposes, we will request consent or otherwise ensure the use is permitted by law. You may withdraw future promotional permission by contacting us, although we may not be able to remove material already lawfully printed, archived or shared by others.

Our website, advertisements and messages may link to external websites, payment services, social networks, mapping tools or review platforms. We are not responsible for the privacy practices of third parties. Review their privacy policies before providing information. A third party may collect information independently even where its service is embedded in our website.

We will acknowledge and investigate the complaint within a reasonable period, may request further information, and will communicate the outcome. Please give us a reasonable opportunity to resolve the matter. If you are not satisfied and the Privacy Act applies, you may contact the Office of the Australian Information Commissioner at oaic.gov.au. Complaints about spam may be made to the Australian Communications and Media Authority at acma.gov.au.
